Martinez was on parole for a previous crime, he had to stay in jail for two months until the charges against him were dismissed.
When Martinez left jail, attorney Ed Chavez said his client, Gary Martinez left with nothing but the clothes on his back.
Gary Martinez and his attorney believe this was against his constitutional rights and being arrested and sent to jail for a DWI with no evidence had left him more than distressed.
